Weyrich’s financial woes continue
Modified: Friday, Feb 5th, 2010

Prior to confirmation that the restaurant and lounge at The Carlton owned by businessman David Weyrich in Atascadero had closed this week, a foreclosure auction held Monday for Weyrich’s properties including Martin & Weyrich Winery, Villa Toscana, York Mountain Winery and Jack Ranch Vineyard in Edna Valley resulted in no bids and eventual surrendering of the properties.

According to Weyrich, no one bid on the properties at last Monday’s foreclosure auction. Lending firm Aegon is now in possession of the properties, Weyrich confirmed via e-mail.

“There are interested persons who are likely to make offers on the properties,” Weyrich wrote in the e-mail.

In addition to surrendering the holdings, the city of Paso Robles recently filed two termination notices and unlawful detainer complaints against North American Jet Charter, Inc./Paso Robles Jet Center, owner by Weyrich, for allegedly defaulting on two leases to operate out of the Paso Robles Municipal Airport.

North American Jet Charter, the fixed-base operator at the airport, also provides services through subsidiary Paso Robles Jet Center.

When asked why the notices were filed, city officials have cited a lack of payment, concerns with regard to service minimum standard requirements and lack of providing charter service, in particular.

According to City Attorney Iris Yang, while unlawful detainer actions are generally supposed to entail somewhat of an expedited process, an exact timeline for how the litigation might proceed between the city and Weyrich was unavailable.

When asked to estimate a timetable, Yang said that, “hopefully we can get it resolved in the next two months.”

“We don' have an exact timetable,” she said.

On top of the litigation and surrendering of the properties, last Sunday El Paso de Robles Municipal Airport Manager Roger Oxborrow confirmed that a NOTAM, or notice to airmen, was recently issued alerting pilots them that fuel would temporarily be unavailable at the airport due to a fuel shortage and lack of delivery by Chevron, with whom the airport receives fuel. If fuel had been ordered sooner, the temporary unavailability of fuel to pilots may have not occurred, Oxborrow confirmed. According to Oxborrow, fuel was restored one day later.

The fuel shortage did not result in any major interruptions at the airport, he said, adding that the NOTAM was cancelled immediately after fuel was restored. He said that the temporary lack of fuel availability did not affect public safety and that there were enough reserves on tap in the case of an emergency.

“Certainly no public safety was compromised,” Oxborrow said.

Oxborrow said that the jet center planned to continue to provide fuel to pilots in the future under the current arrangement.
